Good luck! I had several issues on appeal going back to 1992, or denied without a VA review of my missing service medical records. After over 10-years some issues, and finding of the medicla records were granted outright and others were granted on appeal. Patience is always a virtue when it comes to the process.

    Herkey,
I did not see your message until today, so I looked for today's date (7/26) for your post. The only one I saw was your comment to Cruiser. Then I noticed that the date of your message on my account indicated that you sent it on 7/25. Didn't review the 7/24 post until I sent you the last message. Sorry.

I re-read the entire thread. It appears to boil down to the fourth issue. You did complete a form 9, and, if I understand you correctly, if the VARO doesn't grant, this issue will go to BVA, right? I don't always agree with Cruiser on issues. I think his VARO had ways of doing things, and perhaps, other VAROs have their own ways. Yes, there are subtle differences with VAROs, although they generally conform to HQ on all matters. Now that I'm writing, I'm wondering if you indicated that anyone at the the VARO stated that the previous missing evidence was reviewed? If it has not, and the VARO does not discuss this information in addressing this fourth issue, then BVA will return it in all probability. Since the missing information is critical to this claim, make certain that it is addressed by a DRO prior to going to BVA. What I mean by addressed is, the VARO should inform you in writing or at a hearing that this information was reviewed or of record, at least, in an SSOC or other rating decision. If they ultimately do not address this IMO by the occupational doc, well you know that BVA will. Just make certain that this evidence is in the VA file.

    Thanks for the reply.

I'm going to relax about it and wait for their reply. Hopefully it will be the proper grant of the claim and not some B/// S/// SSOC.
